What’s the divorce process?

Generally, the process goes like this:

1. File pleadings

First, Haven will file the initial pleadings. If you or your children feel unsafe with the other parent, she will set a hearing for temporary protective orders if that is needed. When necessary, Haven will also set a hearing for temporary orders in order to govern property use, child support, and possession and access while the case is pending.

In some cases, gathering facts and putting together “discovery” may be necessary to guarantee all pertinent information to the case is disclosed so that you and the other spouse are properly informed.

2. Mediation

Most of the time, divorces are resolved and finalized in mediation. During mediation, a neutral third-party lawyer who is not directly involved in your case and does not represent you or your spouse serves as the Mediator. This helps assure no bias during proceedings. Mediation is where we will work toward a mutually beneficial settlement regarding custody arrangements, property division, and other similar details. It is important to note that most judges require that parties attend mediation prior to scheduling a final hearing.

3. (Sometimes) Go to trial

If mediation is unsuccessful, your divorce case will go to trial where the judge will make all final decisions concerning who gets what property, where the children will live primarily, and child support. While going to trial is never preferred, it is sometimes necessary. Haven Charlo is not afraid of a fight and will vigorously advocate for you before a judge or a jury.

How quickly will my divorce be finalized?

The time it takes for a divorce to be finalized depends on many things. If your case is straightforward and all terms for the settlement are agreeable from the get-go, the case could be finished very shortly after the 61 day mandatory waiting period.

However, often these cases become messy and complicated. If property disputes or custody battles drag on and lead to a court trial, there is no way to give an accurate estimate for how long those proceedings may take. Haven will do her best to explain the process and provide you with an estimate of how long it may take if the case goes one way versus another.
